Part-time contract in Spain

Surely already know that there are two ways to hire a worker, according to their day: well, we can talk full-time or part-time. Let's see the particularities that this last assumption has.

Part-time contract

According to the Workers' Statute in Spain the work contract will be understood as part-time when the provision of services has been agreed for a number of hours a day, a week, a month or a year, less than the working day of a comparable full-time worker.Normally the full-time day is 40 hours a week, although in case of doubt we recommend looking at the Collective

Agreement that is applicable.

Once we take this into account, it is important to know that this type of contract requires a series of formalities, such as the following:


  • It must always be agreed in writing. In addition, the contract must indicate the number of hours for which it is contracted, otherwise it could be understood that it was held full time.
  • The company must give the worker a copy of the contract. You must also notify the Public Employment Service within 10 days of hiring.


Remember that part-time workers have the same rights as any other. However, for logical reasons Collective Agreements can establish that some of these rights are used proportionally to the number of hours worked, as is the case of salary.
