Permanent residence permit

In order to obtain a permanent residence permit, the Aliens Act requires that a number of unavoidable conditions be met.

Minimum stay requirement: One of these requirements is that you must have resided legally and without interruption in Spain for at least 5 years.
In some special situations this period may be reduced. For example:

  • If you are receiving a contributory retirement pension or a pension for total permanent disability or invalidity
  • If you have been a Spaniard of origin but lost your nationality (for example, if you lived in a foreign country for many years)
  • If you have refugee status
  • For contributions to the scientific, economic or cultural progress of Spain.



It is also essential to have no criminal record both in Spain and in the country of previous residence.

Possessing a permanent residence permit allows you to benefit from certain rights, such as being able to reside in Spain legally for an indefinite period of time and to work with the same rights and under the same conditions as any Spanish worker.
